Overview
This website is operated by BlackWholeMagazine LLC, trading as BlackWhole Magazine ("we", "us", "our"). We offer this website, including all tools, products and services available on it, conditioned upon your acceptance of the terms, conditions, policies and notices stated here. Our Refund Policy, Shipping Policy and Privacy Policy form part of these Terms.

Section 1 — Online store terms
By agreeing to these Terms of Service you represent that you are at least the age of majority in your state, province or country of residence. You may not use our products for any illegal or unauthorised purpose, nor may you, in using the Service, violate any law in your jurisdiction, including copyright and intellectual property law.
Section 2A — Physical on-demand products
Physical merchandise, including clothing, books, wall art and card games, is manufactured on demand after you order. Cancellation, replacement and refund are governed by our Refund Policy, which forms part of these Terms and which you should read before ordering. We reserve the right to modify or discontinue any product, or to change prices, without prior notice.
Section 2B — The Vault (digital access)
When you buy access to the Vault you receive a personal, non-exclusive, non-transferable licence to read the digital titles included in what you bought, on our website, through your customer account, for your own non-commercial use. The Vault is read online; it is not a download.
What is included. Each Vault purchase covers the specific set of titles described on the product page at the moment you buy — for example, the founding set of six titles. Where a title in that set is listed as still in production, it is added to your library when it is finished, at no extra cost. Titles released after that set, in a later round, are sold separately and are not included unless the product page says so.
Price changes. A set may be offered at a lower price while some of its titles are still in production and at a higher price once it is complete. The price you pay is the price shown at checkout. A later price change never affects access you have already bought, and we do not charge you the difference.
How long access lasts. Vault access is a one-time purchase. There is no subscription, no renewal and no expiry date: titles you have unlocked stay in your library for as long as we operate the BlackWhole digital library. If we ever have to close the digital library, we will email you at least ninety (90) days in advance.
Account sharing and redistribution. Your access is personal to you. You may not share your account credentials, circumvent access controls, scrape, mirror, re-host, resell or redistribute any part of the gated content. If we identify credential sharing or redistribution, we may suspend or end the access concerned, after telling you why.
Section 2C — Limited edition releases
Certain products, including exclusive canvas prints and original artwork, may be offered in strictly limited quantities. Adding a limited-edition item to your cart does not reserve it. A product is secured only on successful completion of checkout and payment. We are not liable for items that sell out while in your cart.
Section 3 — Intellectual property
All content published on this website and supplied with our products — including comics, illustrations, cover art, written prose, card designs, logos, layouts and the site itself — is owned by BlackWholeMagazine LLC or its contributors and is protected by copyright and trade mark law.
Buying a physical item transfers ownership of that physical copy only. Buying a digital pass grants the licence described in Section 2B. Neither grants you any right to reproduce, adapt, publicly display, sell, print, distribute, or train machine-learning systems on our content. All rights not expressly granted are reserved.
Section 4 — Accuracy of billing, pricing and account information
We reserve the right to refuse any order. We may, at our sole discretion, limit or cancel quantities purchased per person, per household or per order. Where we change or cancel an order we will attempt to notify you using the email or billing address given at the time of the order.
Pricing errors. Despite our efforts, an item may occasionally be listed at an incorrect price or with incorrect information. Where an item's correct price is higher than the price shown, we may, before shipping, either contact you for instructions or cancel the order and notify you. We are not obliged to fulfil an order placed at a manifestly erroneous price.
Section 5 — Third-party tools and fulfilment partners
We use third-party fulfilment services, specialised manufacturing partners and secure payment gateways. You acknowledge that such third-party tools are provided "as is" and "as available" without warranties, representations or conditions of any kind, and that we have no liability arising from your use of optional third-party tools. This does not affect our own obligations to you under our Refund Policy or under applicable consumer law.
Section 6 — Limitation of liability
To the fullest extent permitted by law, BlackWholeMagazine LLC, our directors, officers, employees, affiliates, agents, contractors, interns and print suppliers shall not be liable for any indirect, incidental, punitive, special or consequential damages arising from your use of the site, the services or any product purchased through them.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited. Where applicable law does not allow the exclusion or limitation of certain damages, our liability is limited to the smallest amount permitted by that law.
Section 7 — Your statutory consumer rights
If you are a consumer, you benefit from mandatory provisions of the law of the country in which you reside. Nothing in these Terms, our Refund Policy or our Shipping Policy affects your rights under that law, including your right to cancel a distance purchase, your legal guarantee of conformity for faulty goods, and your right to bring proceedings in the courts of your own country.
If something goes wrong, please contact us first at BlackWholeMagazine@gmail.com — we would far rather resolve the matter directly and quickly. If we cannot resolve it, you remain free to contact the consumer protection authority or an out-of-court dispute resolution body in your country.
Section 8 — Governing law
These Terms of Service, and any separate agreements under which we provide you Services, are governed by the laws of the State of Wyoming, United States. This choice of law does not deprive you, as a consumer, of the protection afforded to you by mandatory provisions of the law of your country of habitual residence, which continue to apply in full.
Section 9 — Severability and changes
If any provision of these Terms is found to be unlawful or unenforceable, that provision is severed and the remaining provisions continue in force. We may update these Terms from time to time; the version published on this page at the moment you place an order is the version that applies to that order.
Section 10 — Contact
Questions about these Terms of Service should be sent to BlackWholeMagazine@gmail.com. Our full trading and contact details are published in our Contact Information policy.
