This website is operated legally by BlackWholeMagazine LLC trading publicly as BlackWhole Magazine. Throughout the site, the terms “we”, “us” and “our” refer to BlackWhole Magazine. We offer this website, including all tools, products, and services available to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.

SECTION 1 - ONLINE STORE TERMS

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state, province, or country of residence. You may not use our products for any illegal or unauthorized purpose, nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright and intellectual property laws).

SECTION 2A - PHYSICAL ON-DEMAND PRODUCTS

Certain physical merchandise (including clothing, books, wall art, and card games) are manufactured on-demand and are subject to return or replacement strictly according to our published Return & Refund Policy. We reserve the right to modify or discontinue a product, or change the prices of our products without prior notice.

SECTION 2B - DIGITAL ACCESS PASSES & BATCH CONTENT

When you purchase a digital access pass, you are purchasing a limited, non-exclusive, non-transferable license to access a specific, gated collection of digital media (including written prose, visual art, and digital archives).

Edition-Based Access: You are purchasing access strictly to the advertised Batch or Edition. Purchasing access to the current digital iteration does not grant you free access to future Batches, past Batches, or standalone premium releases.

Hosting Guarantee: Your pass guarantees you access to the purchased digital content for the active lifespan of that specific iteration on our servers, which we guarantee will be hosted and available to you for a minimum of twelve (12) months from the date of your purchase.

Service Sunsetting: We reserve the right to archive, migrate, or retire digital Batches once their guaranteed 12-month hosting window has elapsed. We strongly encourage users to consume the media during the active cycle, as perpetual, lifetime hosting of legacy files is not guaranteed.

SECTION 2C - LIMITED EDITION RELEASES

Certain products (including but not limited to exclusive canvas prints and original artwork) may be offered in strictly limited quantities. Adding a limited-edition item to your digital shopping cart does not reserve the inventory. A product is only secured upon successful completion of the checkout and payment process. We cannot be held liable for items that sell out while in your cart.

SECTION 3 - ACCURACY OF BILLING AND ACCOUNT INFORMATION

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. In the event that we make a change to or cancel an order, we will attempt to notify you by contacting the e-mail and/or billing address provided at the time the order was made.

SECTION 4 - THIRD-PARTY TOOLS & PARTNERS

We utilize third-party fulfillment services, specialized manufacturing partners, and secure payment gateways. You acknowledge and agree that we provide access to such third-party tools ”as is” and “as available” without any warranties, representations, or conditions of any kind. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.

SECTION 5 - LIMITATION OF LIABILITY

In no case shall BlackWholeMagazine LLC, our directors, officers, employees, affiliates, agents, contractors, interns, or print suppliers be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, arising from your use of any of the services or products procured using the site.

SECTION 6 - GOVERNING LAW

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed strictly in accordance with the laws of the State of Wyoming, United States.
